WELCOME TO THE LUMINATE CAREERS HUB, WHICH IS REFERRED TO THROUGHOUT THESE TERMS AND CONDITIONS AS THE “HUB”. PLEASE MAKE SURE THAT YOU HAVE READ THESE TERMS AND CONDITIONS BECAUSE YOU WILL BE ASKED TO CONFIRM THAT YOU HAVE DONE SO BEFORE YOU CAN REGISTER TO SET UP AN ACCOUNT ON THE HUB. THEY CONTAIN IMPORTANT INFORMATION ABOUT HOW YOU MAY USE THE HUB.
To aid understanding, the terms “us” or “we” or “our” or “ours” refer to Luminate Education Group, which is the owner and operator of the Hub. “You” or “your” refers to you as the user accessing the Hub. “Terms and Conditions” means these terms and conditions, as may be amended or updated from time to time.
1. Use of the hub
1.1. The Hub is provided to you free of charge and solely for your personal use. Your use of the Hub is subject to these Terms and Conditions (“T&Cs”), our Privacy Notice, our Cookies Policy and our Website Terms and Conditions of Use, which you agree to be bound by and comply with. You must be at least sixteen (16) years old to use the Hub.
1.2. If you don’t accept any part of these T&Cs, please do not use the Hub. If you are unclear on any aspect of these T&Cs please contact us using the contact details provided in paragraph 8.
1.3. We may update these T&Cs from time to time. If we make any significant changes to the T&Cs, you will be notified via an announcement on the Hub or via email. If you don’t wish to accept the new T&Cs, please do not continue to use the Hub.
1.4. We cannot guarantee that access to the Hub will always be uninterrupted or fault free. If a service fault occurs you should report it to us by emailing careers@luminate.ac.uk and we will attempt to correct this as soon as we reasonably can. If we temporarily restrict access to the Hub to allow for repairs or maintenance we will always attempt to restore the service as soon as we reasonably can.
1.5. The Hub provides content from other internet sites or resources. Whilst we try to ensure that the material included is accurate and of high quality, we cannot accept responsibility if this is not the case. If we are informed of any inaccuracies in the material on the site we will attempt to correct the these as soon as we reasonably can.
1.6. The Hub includes links to other web sites, applications or material which are beyond our control. We do not accept any responsibility or liability in respect of, any website, application or material which is not under our control.
1.7. We make no warranties, representations, undertakings or guarantees that the Hub is secure or free from bugs or viruses. You are responsible for ensuring that the device from which you access the Hub has suitable anti-virus software in place.
1.8. We make no promise that materials on the Hub are appropriate or available for use in locations outside the United Kingdom. You are responsible for compliance with the laws and regulatory regimes of other countries should you choose to access this site from locations outside the United Kingdom.
1.9. To use the Hub you need internet connectivity and appropriate telecommunication links. We do not provide computers or other necessary equipment to access it and so are not be liable for any internet, telephone or other costs that you may incur.
2. Registering on the Hub and managing your account
2.1. You must register for an account on the Hub in order to use it. Please ensure the details provided by you are correct and complete and inform us in writing of any changes to this information. Keep the password you create upon registering confidential and do not share it with anyone. If you know or suspect that someone else knows your password you must change it.
2.2. You may only use the Hub for lawful purposes and in compliance with all applicable laws, statutes and regulations.
2.3. You must not use the Hub in any way which we would acting reasonably consider inappropriate or unacceptable. This includes, without limitation, interfering with any other person’s use of the Hub, giving the impression that content emanates from us where this is not the case and attempting to disrupt the service in any way.
2.4. You are solely responsible for the content of any submissions you make on the Hub. You agree that anything you submit shall not infringe any right of any third party, nor contain anything libellous or otherwise unlawful, abusive or obscene nor constitute an invasion of privacy. We reserve the right to remove any material you have posted.
2.5. We reserve the right to disable your account at any time if, in our reasonable opinion, you fail to comply with any of these T&Cs, if we consider that there may be a security risk, or on any other reasonable grounds.

3. Our liability to you
3.1. We provide the Hub without any warranties or guarantees. You must bear the risks associated with the use of the Hub. To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Hub.
3.2. Nothing in these T&Cs shall exclude any liability that we cannot limit or exclude at law.
3.3. You agree to indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with any breach of these T&Cs by you or any other liabilities arising out of your use of the Hub or the use of any other person accessing it using your account.
4. Intellectual Property
4.1. The content of the Hub is protected by copyright, trademarks, database and other intellectual property rights. You may not reproduce, modify, copy or distribute or use in any other way for commercial purposes any of the materials or content on the Hub without written permission from us. No licence is granted to you in these T&Cs to use any trade mark of ours or our affiliated entities.
5. Privacy, Data Protection and Cookies
5.1. We are committed to protecting your privacy. For more information please see our Privacy Policy and the Cookie Policy of Tribepad who power the Hub and collect cookies.
5.2. The information collected about you will be stored in our recruitment database. If you have not logged into your account on the Hub for a twelve-month period, we will contact you to ask if you would like to have your account and all personal information deleted. You can delete your account at any time via the Hub. You can also at any time request that we delete your account for you and/or request a copy of the information we hold about you by emailing: careers@luminate.ac.uk or writing to: Careers Hub, HR Department, Luminate Education Group, Park Lane Campus, Leeds LS3 1AA.
6. Applicable Law
6.1. Our T&Cs are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction to determine any dispute arising out of or in connection with them.
7. Miscellaneous
7.1. You may not assign, sub-license or otherwise transfer any of your rights under these T&Cs and a person who is not a party to these T&Cs shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these T&Cs.
7.2. If you breach these T&Cs and the Hub ignores this, we will still be entitled to use our rights and remedies at a later date, or in any other situation where you breach the T&Cs. The Hub shall not be responsible for any breach of these T&Cs caused by circumstances beyond our control.
7.3. When using the Hub, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on or through the Hub. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all emails, texts, contracts, notices, information and other communications that we provide to you electronically comply with any legal or any other requirement that such communications be in writing.
